These terms and conditions will act as a guideline and agreement between Passengers, drivers and our company, Cabme Nig. LTD, a private Limited Liability company under CAMA 2020 (As amended)
TERMS AND CONDITIONS (PASSENGERS)
1. CONTRACT OF SERVICE
These Terms of Use (“Terms”) govern the access or use by users (passengers) and individuals affiliated with and associated with Cabme Nig Ltd. It is pertinent to state that these terms and conditions of use will govern any existing contractual relationship between all parties within and outside Nigeria.
It is also pertinent to note by all passengers booking a ride for whatever lawful purposes and usage, that every driver associated with CABME NIG LTD is an INDEPENDENT THIRD-PARTY CONTRACTOR WHO ARE NOT EMPLOYED BY CABME NIG.
CABME NIG DOES NOT PROVIDE TRANSPORTATION OR LOGISTICS SERVICES OR FUNCTION AS A TRANSPORTATION CARRIER, AND ALL SUCH TRANSPORTATION OR LOGISTICS SERVICES ARE PROVIDED BY INDEPENDENT THIRD-PARTY CONTRACTORS WHO ARE NOT EMPLOYED FULLY OR PARTLY BY CABME NIG. OR ANY OF ITS AFFILIATES. Liability of any such kind is on INDEPENDENT THIRD-PARTY CONTRACTORS (DRIVERS) solely and not CABME. NIG as a company or its management team.
2. HOW WE OPERATE
Our services include a computerised device application software, which acts as a platform that enables users of CABME. NIG mobile applications or website providers gain access for transportation and logistics purposes. Drivers who are independent contractors and passengers who book a ride with CABME. NIG are regularly informed by the use of the application software of the cost of a ride or/and trip, which is carefully and automatically calculated with existing kilometres and times afforded for such a trip.
Time used will be in SECONDS, MINUTES, AND HOURS for such a trip.
As any form of delay in a trip attracts an increase in fee, which will be clearly shown on the application, time is always of the essence.
3. SCRUTINY AND LICENSE PROVISION
CABME. NIG has earlier stated the fact that all its drivers are INDEPENDENT CONTRACTORS and hence exempts itself from liabilities from unprecedented acts from such drivers, although the company, before contracting such drivers, has done their due diligence in terms of scrutiny of those drivers' vehicles, character and persons to give its best services to its respective passengers.
4. SECURITY PRECAUTIONS
Since CABME NIG. is a channel that links both the independent contracted drivers and the passengers, CABME. NIG can only use the necessary available information inherently gotten from such drivers, Cabme. Nig does not have a superficial link or association with their passengers and drivers alike; therefore, passengers and drivers should be vigilant at all times regarding these independent contractors (drivers) who intend to ride with them and vice versa.
NOTE: SAFETY GUIDELINES will be provided, which contain necessary information about the driver before deciding to start the trip, as the assumption when a trip is started is that the user(passenger) willfully, having examined the necessary details of the driver, elects without fear, duress or undue influence to proceed with such trip, and they include;
If by any means a driver starts to misbehave while on duty, passengers should immediately reach out to Cabme. nig customer service centre for reports and actions and, in extreme cases, launch a complaint at the law enforcement agency closest.
5. DISCLAIMERS; LIMITATION OF LIABILITY; INDEMNITY.
CABME NIG will not be responsible whatsoever for any property stolen or any act of theft committed by such driver, as they are independent contractors in the course of riding with this driver. CABME NIG will only provide safety tips, and in the case of stolen property, the company can help to provide information within its knowledge, such as information gotten from the driver's profile available to us and also help in providing relevant information to the best of the Company's knowledge, which will act as a guideline to apprehend the perpetrator and driver as the Case maybe.
6. ACT OF INSUBORDINATION AND NEGLIGENCE;
What is termed 'insubordination' and 'negligence' falls within the exclusive rights of the CABME NIG LTD. Insubordination and negligence, depending on the extent of harm caused, have penalties for such defaulters.
ACTS OF INSUBORDINATION AND NEGLIGENCE ARE OUTLINED BELOW;
A. ACT OF DELAY IN EMBARKING ON A TRIP:
Passengers are not allowed to delay their respective trips except if it is coming from the drivers. CABME NIG has a regulated time space for each trip and kilometre coverage. CABME NIG, in partnership with the Google Maps application, has a designated time interval when such a trip commences and when it ends. Any contrary time spacing is completely annulled, and such commuters will be duly sanctioned, as there are regulated defaulter fees which must be paid before the trip can continue.
B. UNPRECEDENTED AUTHENTICATION
This can be viewed as insubordination to the company. The passengers are not allowed to involve themselves in any form of heated argument before or during their trip. If any form of heated argument occurs, such passengers at first have the right to reach out immediately to the CABME NIG customer care providers on the turn of events for shift intervention.
C. JOBS DONE OUTSIDE THE DUTIES OF THE COMPANY;
CABME NIG does not prevent drivers from carrying out their personal day-to-day driving job; however, if the passengers were passengers who had earlier booked his/her ride through the CABME NIG application, such driver(s) are foreclosed from accepting private bookings of a trip with such passengers, as it is gross insubordination, as drivers are not allowed to embark on such, and in the circumstances where a driver does so, the company will be exempted absolutely from any liability, and no information will be provided in this regard, as the driver, as an independent contractor, does so at his/her own frolic.
D. CRIMINAL ACTS
Acts such as sexual immorality, sexual advancement, assault in any form whatsoever, theft, and kidnapping are totally illegal and unlawful, and the company will never involve itself in such practices and will help the relevant authorities to provide information for the arrest and prosecution of such drivers or passengers, as the case may be.
7. DISPUTE RESOLUTION AND CONFLICT
All disputes whatsoever are subject to the ADR (ARBITRATION AND DISPUTE RESOLUTION) procedure.
8. PAYMENT
All payments are generally paid directly to the company mobile app, which is regulated via time and kilometre coverage. No cash payment or transaction is allowed.
An e-wallet will be provided for passengers who wish to have some leftover cash for subsequent trips.
9a. RESTRICTIONS IN SERVICE
You may not: (i) remove any copyright, trademark or other proprietary notices from any portion of the Services; (ii) reproduce, modify, prepare derivative works based upon, distribute, license, lease, sell, resell, transfer, publicly display, publicly perform, transmit, stream, broadcast or otherwise exploit the Services except as expressly permitted by CABME; (iii) decompile, reverse engineer or disassemble the Services except as may be permitted by applicable law; (iv) link to, mirror or frame any portion of the Services; (v) cause or launch any programs or scripts for the purpose of scraping, indexing, surveying, or otherwise data mining any portion of the Services or unduly burdening or hindering the operation and/or functionality of any aspect of the Services; or (vi) attempt to gain unauthorised access to or impair any aspect of the Services or its related systems or networks.
9b. RESTRICTIONS IN SERVICE
Passengers' ages for booking a ride with CABME NIG are limited to 16-80 years; any age outside this limit must be booked with the express permission of their guardian, parents who must fall into the aforementioned age range to book a ride with CABME NIG.
10. SPECIAL ORDERS
Passengers are open to making special orders to request a constant daily ride to themselves, friends, family and children, whether infants or aged individuals, on a monthly, quarterly or yearly package. This special arrangement would attract some level of discount by the company, subject to its judgment and assessment, and its overriding convenience.
